Terms of Service — Cal Athletics Marketing
Effective: 2026-06-01
1. The Program
These Terms of Service govern your participation in the Oski program (the "Program") — Cal Athletics Marketing's text alert and AI fan service. The Program is a managed fan experience provided by [Legal Entity] ("Cal Athletics Marketing") and operated on its behalf by Snapp Stats, Inc. ("Snapp"). The Program does not transmit Sex, Hate, Alcohol, Firearms, or Tobacco ("SHAFT") content. By opting in, you agree to these Terms.
2. Eligibility
To use the Program you must:
- Be at least 13 years old (and at least 18 if you are a California resident, to provide your own consent to receive marketing messages)
- Be the authorized user of the mobile phone number you provide
- Have a US-based mobile number (the Program is currently available in the United States only)
3. Opt-in and consent
By providing your phone number and checking the consent box on the opt-in page, you expressly consent to receive recurring automated marketing and informational RCS and/or SMS messages from Cal Athletics Marketing at the number provided. Your consent constitutes "prior express written consent" under the federal Telephone Consumer Protection Act ("TCPA"), 47 U.S.C. § 227 et seq. Consent is not a condition of any purchase.
4. Message frequency
Message frequency varies — volume depends on the season, events, and your engagement — plus replies to your questions.
5. Message and data rates
Message and data rates may apply. The Program is free from Cal Athletics Marketing, but your mobile carrier may charge for the messages you send and receive based on your plan. Contact your carrier for details.
6. Help and opt-out
- Reply HELP (or INFO) to any message for help and contact information. The HELP auto-response identifies the Program by name, lists Cal Athletics Marketing's support contact, the message-frequency expectation, and the opt-out instructions in this Section.
- Reply STOP (or END, CANCEL, UNSUBSCRIBE, or QUIT) to any message to opt out at any time. You will receive a confirmation message and no further messages will be sent.
- You may also opt out by emailing support@snappstats.com or by submitting an opt-out request via the Program website. Email and web opt-out requests are processed within one business day.
- To rejoin, reply START or opt in again on the Program's website.
7. Carrier liability
Mobile carriers are not liable for delayed or undelivered messages. Delivery of messages is subject to your carrier's network availability, your device, and other factors outside our reasonable control.
8. Changes to the Program
We may modify, suspend, or discontinue the Program at any time without notice. If we make material changes to these Terms, we will provide notice through the Program or by other reasonable means.
9. Acceptable use
You agree not to:
- Provide a phone number that is not yours, or impersonate another person
- Use the Program to harass, threaten, or harm others
- Attempt to disrupt, reverse-engineer, or interfere with the Program
We may suspend or remove access to the Program for users who violate these Terms.
10. Disclaimers
The Program is provided "as is" and "as available". To the maximum extent permitted by law, Cal Athletics Marketing and Snapp disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. Responses generated by the AI fan service are provided for convenience and may contain errors; verify important information independently.
11. Limitation of liability
To the maximum extent permitted by law, neither Cal Athletics Marketing nor Snapp will be liable for indirect, incidental, special, consequential, or punitive damages arising from your use of the Program. The total aggregate liability of Cal Athletics Marketing and Snapp under these Terms will not exceed the greater of (a) one hundred US dollars ($100), or (b) the amount you paid for the Program in the twelve months preceding the event giving rise to the liability. You acknowledge that the Program is provided to you at no charge and that this cap reflects the allocation of risk between the parties.
12. Governing law
These Terms are governed by the laws of the State of California, without regard to its conflict-of-laws principles. Subject to Section 13 (Dispute resolution; arbitration; class action waiver), any dispute will be brought exclusively in the state or federal courts located in Alameda County, California, and you consent to personal jurisdiction there.
13. Dispute resolution; arbitration; class action waiver
Please read this section carefully. It affects your legal rights, including your right to file a lawsuit in court.
a. Informal resolution first
Before initiating any formal dispute, you agree to contact us at legal@snappstats.com with a written description of the dispute, the relevant facts, and the relief you seek. We will attempt to resolve the dispute informally within 30 days of receipt.
b. Binding individual arbitration
Any dispute not resolved informally arising out of or relating to these Terms or the Program will be resolved exclusively through final, binding individual arbitration administered by the American Arbitration Association ("AAA") under its Consumer Arbitration Rules in effect at the time the arbitration is commenced. The arbitration will be conducted in Alameda County, California — or by phone or video at the arbitrator's discretion — unless you and we agree otherwise. The arbitrator's award will be final and may be entered as a judgment by any court of competent jurisdiction.
c. Class action waiver
YOU AND WE EACH AGREE TO RESOLVE DISPUTES ONLY ON AN INDIVIDUAL BASIS. NEITHER YOU NOR WE MAY ASSERT ANY CLAIM AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, COLLECTIVE, REPRESENTATIVE, MULTI-PLAINTIFF, OR CONSOLIDATED ACTION. The arbitrator may not consolidate more than one person's claims and may not preside over any form of representative or class proceeding.
d. Jury trial waiver
YOU AND WE EACH WAIVE ANY RIGHT TO TRIAL BY JURY IN ANY DISPUTE BETWEEN YOU AND US, EXCEPT AS REQUIRED BY APPLICABLE LAW.
e. Small claims carve-out
You and we retain the right to file an individual action in any small claims court for disputes within that court's jurisdiction, in lieu of arbitration.
f. Opt-out of arbitration
You may opt out of this Section 13 by emailing legal@snappstats.com with the subject "Arbitration Opt-Out" within 30 days after first agreeing to these Terms. Your opt-out must include your full name, the mobile number you used to opt in, and a clear statement that you decline to be bound by this Section. Opting out will not affect any other portion of these Terms.
g. Severability of this section
If any portion of this Section 13 is held unenforceable, the rest will remain in effect; provided, however, that if the class action waiver in subsection (c) is held unenforceable, the entirety of this Section 13 will be void and disputes will instead be resolved in court as set forth in Section 12.
14. Assignment
You may not assign these Terms or any rights or obligations under them. Cal Athletics Marketing and Snapp may assign these Terms, in whole or in part, in connection with a merger, acquisition, reorganization, sale of assets, or by operation of law, without notice to you.
15. Severability
If any provision of these Terms (other than Section 13, which is governed by its own severability clause in subsection (g)) is held invalid or unenforceable, that provision will be enforced to the maximum extent permissible and the remaining provisions will continue in full force and effect.
16. Entire agreement
These Terms, together with the Privacy Policy referenced below, constitute the entire agreement between you and Cal Athletics Marketing (and Snapp, as operator) concerning the Program and supersede any prior agreements or understandings on the subject.
